Sharing a Hanoi Rental Bike Between Licensed Riders: Contract Questions
About 9 minutes to read
Two friends can both be capable motorcycle riders and still disagree about whether a rented scooter may pass between them. A valid driving licence answers only one question: whether a person meets the relevant licensing condition. It does not, by itself, establish that the rental provider has agreed to that person using this specific bike. Before two people alternate riding in Hanoi, put each name, the permitted vehicle, the period of use and the procedure for returning the keys into a written exchange with the shop. This article is about approving a second active rider, not asking a friend merely to deliver a parked bike at return. It offers a practical conversation and record sequence, not a guarantee about any provider’s insurance or contract.
Start with two separate permissions
First establish legal eligibility for each proposed rider. The Law on Road Traffic Order and Safety, Law 36/2024/QH15, addresses driver age, health, vehicle categories and suitable driving licences in its driver eligibility and licence provisions. Foreign visitors should examine their actual national licence, any qualifying international permit and the motorcycle category rather than treating a car licence or an English translation as automatic authority. Rules concerning older licences and electric vehicles can differ by category and transitional provision. The relevant statutory text is linked in the sources below; if the document or its recognition is unclear, verify it before the motorcycle moves.
Second, separate road eligibility from the shop’s permission. The rental contract may identify one person as the renter, allow a specifically named additional rider, or prohibit lending the vehicle altogether. Ask what the signed terms say about additional operators, deposits, vehicle care, a crash, traffic tickets and return acceptance. A shop employee’s casual comment is less useful than a dated confirmation tied to the bike’s registration plate. The US Federal Trade Commission discusses additional-driver restrictions in the different context of American car rentals; that source illustrates why the question matters but does not define Vietnamese motorcycle contracts.
The five things to confirm before either rider leaves
Identify the two people precisely enough for the provider to approve them without sharing unnecessary personal data. Ask whether both riders must appear at the shop or whether secure copies of documents are sufficient. Confirm that the provider knows which person signed and who is the permitted additional rider. Establish the exact plate and model, because an approval for an earlier bike may not carry over automatically if the shop swaps vehicles. Ask about the pickup and return window and any geographic or use restrictions; do not presume permission to travel outside Hanoi just because a second rider is approved.
Ask the shop to describe consequences, not merely to say “yes.” Who makes the first emergency call? Who should report a scratch, a roadside stop or a lost key? Who may accept a replacement motorcycle? Are helmets and other supplied equipment sufficient for two people, and are there charges or extra deposit requirements? Finally, request a single written reply confirming both driver identities and the plate. A good record is short enough to find later and clear enough for a different staff member to understand. A long chain of ambiguous voice messages is not an adequate substitute when the questions remain unanswered.
Keep the rental agreement and the licence check separate
The rental agreement is evidence of contractual permission; the rider’s licence and other required vehicle documents concern road eligibility. Neither replaces the other. Under Vietnam’s road safety framework, drivers normally need the documents appropriate to the vehicle, including registration, relevant licence and compulsory civil liability insurance documentation, subject to the statutory exceptions. That does not mean a second named renter is automatically insured against every loss. A compulsory third-party liability document, a rental company’s damage waiver and an individual traveller’s insurance policy are different arrangements with different beneficiaries and exclusions.
If the shop offers a waiver or claims that two riders are covered, ask for the policy or clause and read how authorised-driver status is defined. Do not write “full insurance” on your own notes unless the actual wording explains its scope. Pay attention to exclusions for inexperienced riders, professional delivery use, alcohol, speed or a driver not disclosed to the provider. Do not invent a universal rule about coverage. The correct answer depends on the actual insurer, document and contract; an unclear answer is a reason to postpone the switch rather than gamble on a reassuring slogan.
Use a deliberate key handover
At the moment one rider finishes and another takes over, stop at a safe parking place. Do not switch roles while the bike is moving or while either person is distracted in traffic. Put the vehicle securely on its stand, switch off the engine where appropriate and move away from the flow of vehicles before discussing instructions. Record the rough time, location and current odometer reading for your own trip log. Photograph the visible condition if the scooter has been on a demanding route. Then check that the new rider understands the real bike’s brakes, engine-stop control, fuel level, stand behaviour and any unusual display.
A simple handover record is not intended to turn two friends into separate rental companies. It protects both sides against honest memory differences. The first rider can report a cracked mirror or fuel gauge issue while the location and circumstances are fresh. The second can decline to ride if the motorcycle suddenly feels wrong. The Motorcycle Safety Foundation’s T-CLOCS checklist gives a useful general framework for tires, controls, lights, fluids, chassis and stands; it is a safety guide, not a Vietnamese rental contract or permission to adjust someone else’s vehicle.
A practical message you can send to the rental shop
Use a message such as: “We rented plate (number), model (model), from (start date) to (return date). The contract is in (first rider’s name). May (second rider’s name), who holds the appropriate valid motorcycle driving documents, also ride this vehicle? Please confirm whether you need to check their licence, amend the rental agreement, change any insurance or deposit terms, and who must return the motorcycle and keys. We will not transfer the keys for riding until you confirm.” Send it through the shop’s already verified contact channel.
The exact message must reflect your actual documents and planned use. If the shop asks to amend the signed paper, inspect the amendment for matching dates, registration number and rider spelling. Keep the confirmation accessible offline as well as in the conversation. Do not place a passport photograph into an unknown group chat or use an unverified phone number from a social media comment. If the named provider changes, verify the identity of the business receiving that sensitive information before sending it.
When the riders disagree or plans change
Suppose the first rider needs to fly home early while the second will keep using the scooter for a week. That is not merely an afternoon key switch: the remaining period, deposit return, contact information and responsibility may need a documented amendment. Ask whether the original renter must attend a new handover or whether a new agreement is required. Do not assume a second rider can keep a motorcycle indefinitely because their name appeared in an earlier chat. A longer or different use may introduce a fresh question that the original approval never answered.
If one rider loses a key, gets a traffic fine, notices damage or feels ill, report the event promptly through the shop’s agreed channel. Do not conceal which person had the vehicle at the time. Present the actual facts without prematurely assigning blame or promising payment before the relevant documents are reviewed. A sensible written record includes the plate, location, safe condition of the bike and the shop’s next instruction. If riding safely is in doubt, stop use and seek professional help instead of sending the other rider back into traffic as an improvised solution.
What a second rider does not change
An additional authorised operator does not erase the original booking conditions. The same return deadline, fuel arrangement, prohibition on unauthorised repairs, permitted route and requirements to care for the bike can still apply, unless the parties agree otherwise. Nor does the second person’s more extensive riding experience turn a 50cc or electric scooter into a different legal vehicle class. Check the specific model and applicable licence categories, especially where friends are comparing old national driving permits or certificates issued abroad.
If one person is not legally eligible for the specific motorcycle, do not solve the problem by excluding that person’s name from the contract while letting them ride. Likewise, a permitted rider should not hand the bike to a third friend merely because “two riders were approved.” Make any material change explicit, retain the shop’s answer and keep the motorcycle parked while eligibility is being clarified. Permission should follow the person and vehicle actually involved, not a general assumption about what tourists commonly do.
Return and close both riders’ records
Near the end of the rental, confirm who will physically return the bike and who will receive the deposit. An approved additional rider is not automatically authorised to accept someone else’s money or sign a final settlement. Ask whether both people are required, whether a written delegation is accepted, and how the provider will check the identity of the person collecting the refund. If another staff member attends the handover, show the written arrangement rather than expecting them to remember an earlier phone call.
Document the bike’s condition and every supplied item at return, especially spare keys and two helmets if those were issued. Compare the end-of-rental record with the original pickup and any intermediate rider-switch notes. Our related return checklist addresses the physical inspection and receipt in more detail, whereas this page focuses specifically on the permission and accountability of two active drivers. Close the contract in writing and keep the relevant messages with the receipt until the agreed settlement is complete.

Frequently asked questions
Can two licensed friends automatically share one rented scooter?
No. Each rider must have the appropriate legal eligibility, and the rental provider must permit the arrangement under the actual agreement. A licence establishes a driver condition, not a blanket right to lend the rented motorcycle. Get the shop’s written approval for the second person and plate before changing riders.
Does compulsory motorcycle insurance cover both riders?
Do not assume so from the existence of an insurance certificate. Compulsory civil liability insurance, optional waivers and personal travel insurance serve different purposes, and exclusions may depend on driver status and other conditions. Ask the provider or insurer for the actual policy wording relevant to both named riders.
What if the second rider has only a foreign car licence?
A car licence is not automatically proof of permission to ride a motorcycle. Vietnam’s road law distinguishes vehicle classes and the circumstances under which foreign licences or international permits are recognised. Verify the exact rider’s documents against the vehicle category and current applicable rule before handing over the keys.
Can the second rider return the vehicle and collect the deposit?
Only where the provider authorises that return and settlement arrangement. Agree on the returning person’s name, identification method, return time and who receives any refund. Keep the confirmation alongside your pickup record and final return receipt.
