Stopped by Traffic Police in Hanoi: What to Have Ready and What to Ask
About 7 minutes to read
Which documents does a rider show when traffic police stop a foreigner in Hanoi? This page sets out what the official Vietnamese texts read for this page say, how a stop is signalled, and how four foreign-government pages compare with the law text and with each other. The shop questions near the end are general guidance, not statements from a page.
The papers Article 56 lists for a rider
The Nghe An government site reproduces the Law on Road Traffic Order and Safety (Law 36/2024/QH15, adopted 27 June 2024). Article 56(1) says a driver on the road must carry the four items below.
| Item | What Article 56(1) says |
|---|---|
| Registration | The vehicle registration certificate, or a certified copy together with the original of the lender’s confirmation when the vehicle is mortgaged |
| Driving licence | A licence suitable for the type of vehicle being driven |
| Inspection | The technical-safety and environmental inspection certificate for motor vehicles, as prescribed by law |
| Insurance | The compulsory civil-liability insurance certificate of the motor-vehicle owner |
Article 56(3) adds that papers integrated into an electronic identification account can be shown and checked through that account. Rental Motorbike Registration in Vietnam: Match the Bike to Its Papers is a separate page on the bike’s registration papers.
Mopeds and the inspection item
Article 34 defines a moped as a two- or three-wheeled vehicle with a design speed up to 50 km/h and, for a combustion engine, a capacity up to 50 cm3 (electric: up to 4 kW). Article 56(1) excepts moped riders from its licence wording; Article 56(4) asks instead for knowledge of the rules, riding skill, and the age and health conditions of Article 59, which sets 16 as the moped age. Smartraveller and the Canadian advisory put the Vietnamese-licence line at 50cc or more, while the law text counts an engine of 50 cm3 as a moped; no page reconciles the two.
On the inspection item, Article 42(2) says inspection of motorcycles and mopeds covers exhaust emissions only. None of the pages says which paper, if any, a motorbike rider is asked to show for it.
Foreign licences and permits: where the sources disagree
The table gives each statement with the page’s date where it shows one.
| Source | What it says |
|---|---|
| Law 36/2024/QH15, Article 57(6)(b) and 57(8) | An international licence plus a national licence for the category driven, issued by a state party to the 1968 Vienna Convention, is valid; the holder must carry both, in date |
| GOV.UK (modified 21 September 2026) | Both the 1968 version of the international driving permit and the UK licence are needed for a car or motorbike |
| United States embassy (page metadata: modified 15 July 2025) | Foreign licences, even with an international driving permit, are not valid; an ASEAN licence may be recognised in certain circumstances |
| Smartraveller (updated 24 September 2026) | Australian licences and Australian-issued permits are not allowed; a valid Vietnamese licence is needed |
| Travel.gc.ca (updated 19 October 2026) | Canadian licences and permits issued in Canada are not recognised; readers are told to consult Vietnamese authorities |
The pages do not explain the gap. Only the law text and GOV.UK refer to 1968 (the 1968 Vienna Convention and the 1968 version of the permit); the other three pages do not mention it. Grounds for a stop and how it is signalled
Article 66 lets traffic police stop a vehicle for inspection on one of four grounds: a violation seen or reasonably established; an order or plan of a competent authority; work on national security, public order, crime, disaster, fire, rescue or epidemics; or a report or complaint about a crime or other violation. Article 65(5) says the checks cover traffic rules and the conditions of vehicle and driver; Article 65(6) lists principles for officers, including respect for lawful rights and responsibility for their own conduct.
The Ministry of Public Security page of 29 November 2024 summarises Circular 73/2024/TT-BCA (in force from 1 January 2025). It says a stop must be safe, lawful and not obstruct traffic, and that once a vehicle has stopped the officer must carry out the control and handle any violation as prescribed. The signal can be a baton, whistle, loudspeaker or patrol-vehicle priority signal, or signs, cones and barriers; the driver must slow down and stop where the officer directs.
Showing a licence on a phone or by number
The Traffic Police Department’s page of 29 July 2025 says a person can show a licence updated on the VNeID app or, if it is not updated, give the licence number for officers to look up in specialist software. If officers do not accept an electronic check, the page says the person may pass this on to the road-safety information telephone numbers of the Department head and of provincial traffic police chiefs, and the Department will direct verification and handling. The page speaks of people who passed a licence test; it does not say whether a foreign licence or permit can be checked this way.
Identification, passports and fines
GOV.UK says photographic ID has to be carried at all times and that the authorities will accept a printed copy of the photo page of the passport and visa. The Canadian advisory says local authorities may ask to see ID at any time and advises carrying it or a photocopy. GOV.UK also says not to use a passport as a deposit for hiring vehicles or as a guarantee of paying a traffic fine, and not to give it as a guarantee to motorcycle rental shops or landlords, who it says can hold it against claimed damage.
Smartraveller says authorities may fine a rider without a valid licence and that a travel insurer will likely deny claims from an unlicensed rider or one with the wrong class; it suggests contacting the relevant ward police. GOV.UK says it is illegal to drive without third-party insurance. Compulsory Motorbike Liability Insurance in Vietnam: What the Certificate Covers and What a Renter Should Check is a separate page on the insurance certificate.
Questions to settle with the shop
These come from the lists above, not from any page. Apart from the GOV.UK warning that rental shops can hold a passport against claimed damage, no source read here says what a rental shop supplies, holds or requires.
- Which of the four Article 56 papers go with this bike, and are they originals or copies? The law text names a certified copy only for a mortgaged registration certificate.
- Where is the insurance certificate kept, and what dates does it show?
- Which licence or permit does the shop expect, and which page or office does it rely on? The sources above differ.
- Does the shop want to hold a passport or another item as a deposit? Compare with the GOV.UK lines above.
- If an officer keeps a paper or hands over a written record, whom should the rider call, and what should the shop see afterwards?
What the pages leave out
- Fine amounts for missing papers, how a fine is paid, and whether an officer may keep a document at a stop: the law text read mentions temporary holding of papers only in its traffic-accident provisions (Article 83(2)(c)) and in a licence-revocation rule (Article 62(5)(c)).
- Any wording for questions to an officer, or a statement that the ground for a stop must be said aloud: the pages give the grounds in Article 66 and principles in Article 65(6).
- Whether an officer may ask a foreign rider for a passport or a copy: only the GOV.UK and Canadian pages speak of carrying ID at all times or on request, and no Vietnamese page read does.
- The text of Circular 73/2024/TT-BCA itself, which was not read.
- Later changes: the Nghe An page shows the law as adopted on 27 June 2024 and does not say whether the articles cited were amended; check the consolidated text on an official legal database.
- Which paper a motorbike rider shows for the inspection item, and which licence statement an officer applies at the roadside.
